Description
Insurance, in its broadest sense, plays an important role in everyday life of ordinary citizens and business entities. The modern commercial world and the market of goods and services is incomprehensible absent of quality insurance mechanisms. The long-term development of this legal field, as well as the broad field of everyday activities and needs, has produced a number of highly specialized insurance categories and types of insurance contracts. In practice, most lawyers are likely to encounter the Insurance Law: privately, as a party to a motor vehicle insurance, property insurance and liability insurance contract, as well as professionally, as a representative of a contracting part in a dispute concerning insurance matters. It is, therefore, necessary for each student - future lawyer - to learn and understand the basics of this large and import legal field, in order to ease managing and resolving the specific issues in connection to and terminology of Insurance Law.

Cognitive Skills:

Knowledge and understanding

After successfully completing the course, students will be able to:

- define the basic types of insurance

- define main insurance law sources

- explain the importance of insurance law in everyday life and commercial activities

- explain the legal framework of conducting insurance business

- critically assess and recognize the role of insurance and insurance industry in trade

- distinguish between the specific legal institutes of insurance law within the context of international trade

- explain the relationship between the parties to an insurance contract, and third parties

- discuss the role and importance of liability insurance

- explain the particularities of special risks coverage (war risks, terrorism risks and natural disasters risks)

- explain the role of reinsurance in international trade

 

Application

After successfully completing the course, students will be able to:

- interpret the individual legal institute of insurance law present in insurance contracts

- apply the individual legal institute of insurance law present in insurance contracts in practice

- apply the knowledge on insurance law in understanding the international trade

- demonstrate the ability to resolve legal issues arising from insurance contracts and practical examples

- allocate the applicable statutory solution to practical examples

- utilize statutory norms and case practice in insurance law

 

Analysis

After successfully completing the course, students will be able to:

- categorize main types of insurance

- differentiate between main types of insurance

- demonstrate the understanding of life insurance legal issues

- differentiate between the life insurance and accident insurance contracts

- demonstrate the understanding of property insurance legal issues

- demonstrate the understanding of cargo insurance legal issues

- demonstrate the understanding of transport insurance legal issues

- demonstrate the understanding of liability insurance legal issues

- differentiate between reinsurance and insurance contracts

- understand the influence of international and European law on the domestic law regulation of insurance law

- question the adequacy of current regulation of specific legal institute of insurance law with a view on de lege ferenda

After successfully completing the course, students will be able to:

- construct the interconnectivity between insurance law and international trade

- discern the rights and obligations of parties to insurance contracts

- adjourn the correct legal norms application in concrete insurance law case examples

- construct the interrelationship between different actors in insurance and reinsurance constructs

- define the logical structure of statutory and proprietary insurance law aspects

After successfully completing the course, students will be able to:

- compare the legal structure of relationships occurring in different type of insurance contracts

- evaluate the level of statutory regulation of parties’ rights and obligations and the level of contractual regulation of parties’ rights and obligations

- evaluate the quality of statutory norms regulating the insurance practice

- estimate the benefits and deficiencies of individual legal institutes of insurance law

- evaluate the relevant circumstances of each insurance case example and select the most appropriate legal remedy

- compare the similarities and differences between different type of insurance contracts
