Description:

The international scientific conference “Jurisprudence in the Mirror: The Civil Law World Meets the Common Law World” was organized on the occasion of the publication by Oxford University Press of the homonymous book, with Law School Professor Luka Burazin as one of the editors.

The basic idea of the book is an attempt to respond to the “cultural split” that exists in the contemporary analytical theory and philosophy of law. Namely, even though the theory and philosophy of law deal with issues that should be common to all, or at least to “Western” legal systems, there seems to be a major difference in the way these issues are approached by Anglo-Saxon theorists, and by the analytical theorists from continental law states. Furthermore, while continental theorists often refer to the works of theorists from the Anglo-Saxon circle, the opposite appears to be relatively rare, certainly also due to the language barrier. This division is obvious to almost anyone familiar with the subject. However, it has neither been described nor explained in a systematic way.

Hence, the book aims to be the first systematic attempt to overcome these divisions, especially by conveying the knowledge of the continental analytical theory of law to the Anglo-American audience. Twelve common philosophical and legal theoretical questions are addressed in the book through a series of essays and commentaries on essays by eminent authors from both sides of the divide. The book includes the following chapters: 1) Legal philosophy, 2) Legal positivism, 3) Legal norms and normative relevance, 4) Legal validity and other properties of legal norms, 5) Rules and principles, 6) Legal system, 7) Sources of law, 8) Gaps and antinomies, 9) Constitutional democracy, 10) Legal interpretation, 11) Legal reasoning, and 12) Legal science.

At the meeting itself, the editors of the book and a few essay authors will explain in more detail the problem to which the book responds and present their views on the differences and similarities of the two approaches.

Description:

In December 2022, it will be two decades since the entry into force of the Constitutional Act on the Rights of National Minorities. The aim of the international scientific conference “The first twenty years of the Constitutional Act on the Rights of National Minorities ” is to consider the effects of the Constitutional Act on the Rights of National Minorities on the position of members of national minorities in Croatia.

In addition to the plan to specifically discuss the positive and negative sides of the institutions created by the Constitutional Act (e.g. the Council for National Minorities, councils and representatives of national minorities, representatives of minorities in the Parliament or in representative and executive bodies at the local level), it will be specifically questioned whether the Act contributed to the integration of members of national minorities. In this way, the exchange and dissemination of high-quality basic and applied knowledge and understanding of the realization of constitutional obligations and of the obligations arising from international treaties on human and minority rights will be achieved, and it will be possible to analytically deal with both internationally and nationally significant issues concerning the exercise of rights of national minorities.

The added value of the conference is that it ensures the inter-institutional cooperation of all four law faculties of law in the country (in Zagreb, Rijeka, Split and Osijek) and creates space for the engagement of all qualified scientists and experts from several European countries who are able propose guidelines for improving future Croatian minority policy.

In addition to members of the domestic and international academic community, the conference will be attended by the representatives of the Croatian Parliament and the Croatian Government, by representatives of the Constitutional Court of the Republic of Croatia, of national minorities in the Croatian Parliament, by representatives of the Council for National Minorities, by the representatives of relevant ministries, associations and councils of national minority and experts relevant to the protection of the rights of national minorities in practice.
