Description
Legal relations of administrative and judicial powers. Control over the activities of administration. Relations between administration and natural and legal persons. Legal status of natural and legal persons in relation to administration. Responsibility of the state, units of local self-government and other bodies of public administration and their employees for damage incurred to natural and legal persons in performing authoritative activities. Administrative contract. Certificates. Administrative legal relations of property nature. The concept of common property and public property. Kinds of public property. Administrative legal regime of management and use of common and public property. Authoritative intervention of administration in restriction or deprivation of property. Special administrative control over dangerous objects and objects of special importance. Restrictions of rights and compensation due to special burdens.Basics of European administrative law.

Cognitive Skills:

Knowledge and understanding

After successfully completing the course, students will be able to:

- define institutions, public service and administrative contracts;

- critically evaluate and recognise different manners of the acquisition of Croatian citizenship;

- explain acquisition of Croatian citizenship;

- explain the liability of the state for damage considering a claim;

- indicate different organisational forms in the state administration system;

- explain basic elements of misdemeanour law;

- explain basic elements of European administrative law.

 

Application

After successfully completing the course, students will be able to:

- group and describe systems of liability of the state for damage;

- understand the meaning of the institute of concession and its legalities;

- apply knowledge about personal status of citizens in order to independently make entries in the state registries;

- use knowledge about judicial protection of rights before the European Court.

 

Analysis

After successfully completing the course, students will be able to:

- analyse the difference between an institution and a public institution

- distinguish among different public services and recognise providers of public services;

- analyse fulfilment of criteria for the acquisition of Croatian citizenship by naturalization, regular or under special conditions

- compare types of expropriation and different consequences for the right of ownership that derive from the application of individual type:

- analyse manners of providing judicial protection in European law;

- analyse the procedure of granting concession

 

Synthesis

After successfully completing the course, students will be able to:

- contruct a solution of the problems that occur during the procedure of granting concession or conducting expropriation procedures;

- distribute the roles of individual bodies that perform various state administration tasks

- examine how a certain public good is used, is it a good that everybody can use or its usage is restricted in some way

- evaluate the criteria for selecting the best offerer in the procedure of granting concession

- assess justifiability of expropriation for performing works or building objects on a certain real estate

 

Evaluation

After successfully completing the course, students will be able to:

- examine the legality of conducted procedures of granting concessions, expropriation, acquisition of citizenship etc.

- compare justifiability of announcing and cessation of certain public goods;

- evaluate relations within the state administration;

- evaluate the significance and influence of Europena law on Croatian law;

- estimate the quality of the system of state liability for damage in Croatian law and propose its changes.

Practical and Generic Skills:

After successfully mastering the course, students will be able to:

- clearly and precisely exprewss themselves, presenting acquired learning outcomes;

- argument their opinions;

- adjust to the changes in Croatian legal system due to the Croatian accession to the EU;

- develop ability to learn;

Matching Assessments to Learning Outcomes:

Written examination (test of knowledge with open-end questions of factual type and questions of essay type) and oral examination for all learning outcomes.
