Description:

Introduction: individuals in international law; the concept of human rights; historical overview of international legal protection of human rights. Human rights protection at the universal level: general protection (Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, International Covenant on Economic, Social and Cultural Rights); specific human rights protection at the universal level (protection from slavery, protection from racial discrimination, protection from torture and other cruel, inhuman and degrading treatment, protection from sexual and other forms of discrimination). Protection of the rights of specific categories: protection of refugees; protection of migrants; protection of women's rights; protection of children's rights; protection of minorities; protection of indigenous peoples. Regional systems of human rights protection: European system of human rights protection according to the Convention for the Protection of Human Rights and Fundamental Freedoms; human rights protection within the framework of the OSCE; the European Union and human rights protection; Inter-American system of human rights protection; African system of human rights protection; Arab system of human rights protection.

Knowledge and understanding

After successfully completing the course, students will be able to:

- identify sources of international law rules that protect human rights, and distinguish between specifici features of protection on universal and regional level, and protection of special groups;

- define legal concepts from the area of international law protection of human rights;

- explain international law institutes and mechanisms for protection of human rights, and recognise their connection and integration into the international law system.

 

Application

After successfully completing the course, students will be able to:

- group and describe international law institutes and mechanisms for protection of human rights inview of specific features of protection on universal and regional level, and protection of special groups;

- apply international law norms of protection of human rights to concrete examples from international practice;

- illustrate the significance of international law regime of protection of human rights for the stability of international order and cooperation among the states and other subjects of international law.

 

Analysis

After successfully completing the course, students will be able to:

- analyse processes of the appearance of international law norms of protection of human rights with regard to different levels of protection;

- differentiate international law institutes and mechanisms for protection of human rights with regard to different levels of protection, and compare the scope of legal norms and protection mechanisms in view of specific characteristics of different levels of protection;

- categorise international law norms and mechanisms for protection of human rights;

- examine the application of international law norms and mechanisms for protection of human rights inmodern international practice.

 

Synthesis

After successfully completing the course, students will be able to:

- construct the connection between individual international law institutes and mechanisms for protection of human rights on different levels, and their integration in the entire international law system;

- formulate conclusions about the significance of international law regime of protection of human rights for the overall position of the individual in the international law system, but also with regard to the state as an international law subject.

 

Evaluation

After successfully completing the course, students will be able to:

- evaluate the significance of international law norms and mechanisms for protection of human rights for the position of the individual in modern world order;

- estimate specific features of international law mechanisms for protection of human rights with regard to different levels of protection;

- assess the position of the Republic of Croatia with regard to the obligations resulting from the international law regime of protection of human rights;

- evaluate efficiency of international law norms and mechanisms for protection of human rights.

Practical and Generic Skills:

After successfully completing the course, students will gain cmpetences that enable the analysis of international law norms and mechanism of protection of human rights on different levels of protection, and their correct evaluation. At the same time, students should be able to apply appropriate legal norms to resolve problem situations connected with international law protection of human rights. Gained skills enable the students to adequately use relevant international documents of normative contents (treaties, court decisions, especially decisions of the European Court of Human Rights and the decisions of other international bodies for protection of human rights, particularly the Committee for Human Rights, resolutions etc.)

Matching Assessments to Learning Outcomes:

Knowledge is tested on the basis of written examinations.

Written examination, which is compulsory for all students, consists of checking understanding of sources of international law norms for protection of human rights, international law institutes and mechanisms of human rights protection. Connection and comparison of various levels of international law protection of human rights and the evaluation of efficiency of individual aspects of international law regime of human rights protection, particularly through the practice of the European Court of Human Rights and the Committe for the Rights of Man is expected.
