Opis predmeta
Predmet se bavi etičkim problemima u biomedicini te, dovodeći ih u vezu s ljudskim pravima, uključuje analizu razvoja moralnih i bioetičkih argumenata u zdravstvstvenom pravu u Hrvatskoj i svijetu. Predmet započinje pregledom hrvatskog zdravstvenog sustava te njegovog ustavnog i zakonskog okvira. Naglasak se stavlja na koncepte medicinske etike, prava pacijenata te efikasnosti i sigurnosti zdravstvene skrbi. Posebne teme koje se obrađuju uključuju: povjerljivost, informirani pristanak, lječničku grešku, oblike odgovornosti, vještačenja, medicinska istraživanja i eksperimente, doniranje i presađivanje organa, hitne situacije, intenzivnu njegu, pobačaj, korištenje lijekova i novih medicinskih tehnologija, regulaciju nanomedicine i biotehnologije, matične stanice, pitanja smrti i umiranja, tretman osoba s duševnim smetnjama itd. U različitim temama koje se obrađuju, glavni zadatak ovog predmeta jest naučiti primijeniti bioetičke teorije na slučajeve iz prakse.

Intelektualne (kognitivne) vještine:

ZNANJE I RAZUMIJEVANJE

Nakon uspješno savladanog predmeta student će moći:

  • razumjeti i objasniti temeljne pojmove institucionalnog okvira i razvoja bioetike unutar RH, ali i unutar EU i drugih država kada primjenjivo. Također na međunarodnom nivou (primjenjive pravne akte, područje regulacije, minimalna obilježja i sankcije kaznenih djela i pravno uređenje, praksa ESLJP); razumjeti moralna pitanja i (bio)etičke teorije i biomedicinsku etiku
  • razgraničiti moralna pitanja u području bioetike i zaštite ljudskih prava
  • prepoznati utjecaj bioetičkih teorija i razvoja ljudskih prava u uobličenju pravnih normi u području bioetike (grčki filozofi, kršćanska etika i vrline, teorija prirodnog prava, kantovska etika, utilitarizam, etika brige, medicinska etika);
  • kritički vrednovati i prepoznati važnost poštivanja temeljnih načela bioetike i ljudskih prava, uključivo i ulogu subjekata i objekata koji se javljaju u bioetici
  • definirati posebnosti nacionalnih sustava u području regulacije bioetičkih pitanja i pitanja ljudskih prava koja se tiču bioetike; definirati i raspoznati bioetička pitanja (inducirana koma, pasivna i aktivna eutanazija, prekid trudnoće, asistirana reprodukcija, korištenje embrionalnih i matičnih stanica, kloniranje, DNA analize i bolesti, eksperimenti na ljudima i životinjama, presađivanje organa, osobe s duševnim smetnjama i njihova prisilna i dobrovoljna hospitalizacija, etička pitanja i genetske bolesti, AIDS i globalno širenje zaraznih bolesti, reforma zdravstvenih sustava i njegov utjecaj na ljudska prava pojedinaca, zakonska zaštita ekonomskih, socijalnih i kulturna prava pojedinaca na nacionalnoj, regionalnoj i međunarodnoj razini)
  • grupirati strukturu bioetike i identificirati važna obilježja bioetičkih pitanja, te izdvojiti njihove specifičnosti.
  • izdvojiti najčešća kršenja ljudskih prava u području bioetike te razdvojiti odgovornost pojedinaca i odgovornosti pružatelja usluga

PRIMJENA

Nakon uspješno savladanog predmeta student će moći:

  • interpretirati pojmove u bioetici i ljudskim pravima u skladu s važećim metodama tumačenja; interpretirati propise koji reguliraju bioetiku i ljudska prava
  • demonstrirati uzajamnu uvjetovanost i povezanost bioetike i ljudskih prava, te ilustrirati točke povezanosti nacionalnih propisa s propisima EU i europskim i međunarodnim konvencijama koji reguliraju ovo područje
  • primijeniti stečeno znanje iz područja bioetike i ljudskih prava u praksi;
  • koristiti i na ispravan način interpretirati propise s područja bioetike i ljudskih prava.

 

ANALIZA

Nakon uspješno savladanog predmeta student će moći:

  • analizirati odnos između UN-a, Vijeća Europe i EU, RH i drugih država, međupovezanost pravnih instrumenata i njihov utjecaj na bioetiku i ljudska prava u RH
  • analizirati postojeće norme koje uređuju bioetiku i ljudska prava i odgovarajuću sudsku praksu (nacionalnu i ESLJP) u tom segmentu.
  • ispitati usklađenost bioetiku i ljudska prava u RH s osnovnim načelima kaznenog prava i prava općenito te međunarodnim konvencijama;
  • usporediti stanje biotike i ljudskih prava u RH s odgovarajućim sustavima drugih zemalja te ispitati njihovu usklađenost s pravom VE, EU i međunarodnim konvencijama (prvenstveno konvencijama UN-a);
  • razlikovati različite mehanizme pravne zaštite i regulacije bioetičkih pitanja;
  • provjeriti stupanj i opseg ostvarivanja bioetičkih načela i načela zaštite ljudskih prava u regulaciji bioetičkih pitanja;
  • izdvojiti neodgovarajuće norme te predložiti izmjene i poboljšanja regulacije područja koji se odnosi na bioetiku na nacionalnoj i međunarodnoj razini;
  • ispitati i kategorizirati stečena znanja u pogledu bioetike i ljudskih prava i njihove primjene u društvu;

 

SINTEZA

Nakon uspješno savladanog predmeta student će moći:

  • predlagati potrebne izmjene kaznenog, građanskog i upravnog zakonodavstva po pitanju bioetike i zaštite ljudkih;
  • formulirati osnovna obilježja, prednosti i nedostatke zakonske politike u ovom području i predlagati rješenja za poboljšanja tih sustava;
  • izgraditi metodološki sustav za izradu pisanih radova u području bioetike i ljudskih prava
  • osmisliti protokol izrade pisanog rada i usmene prezentacije, formulirati odgovarajuće hipoteze odnosno istraživačka pitanja i sastaviti koncepte rada odnosno izlaganja s predloškom radne literature.;

 

 

VREDNOVANJE

Nakon uspješno savladanog predmeta student će moći:

  • preispitati načine donošenja regulative koje je od interesa za bioetiku i ljudska prava;
  • ocijeniti kvalitetu, održivost i provedivost implementacijskog nacionalnog zakonodavstva kada se radi o regulaciji bioetičkih pitanja; kvalitetu, održivost i provedivost zakonskih i teorijskih instituta bioetike i ljudskih prava u praktičnim uvjetima;
  • odabrati daljnje izučavanje pojedinih segmenata bioetike i ljudskih prava; te procijeniti najinteresantnija područja za daljnju specijalizaciju;
  • vrednovati postojeća rješenja bioetičkih tema u pravu, njihovu međusobnu usklađenost, usklađenost s pravnim normama, naročito Ustavom RH te odredbama europskog i međunarodnog prava koja reguliraju područje bioetike
Praktične i generičke vještine:

Nakon uspješno savladanog predmeta student će moći:

  • javno prezentirati stečena i usvojena znanja te predstaviti ishode učenja te sudjelovati u raspravama oko regulacije bioetičkih pitanja;
  • izražavati se precizno i jasno uz odgovarajuću razinu argumentacije vlastitih teza;
  • provesti samostalno istraživanje zakonodavstva i prakse europskog i nacionalnih sustava;
  • unaprjeđivati komunikacijske i analitičke vještine te stečena znanja;
  • sudjelovati u timskom radu, rješavanju hipotetskih i praktičnih problema u području bioetike
  • raditi u praksi koja zahtjeva poznavanje problematike bioetike i ljudskih prava.
Povezivanje ishoda učenja i provjere znanja:
  1. Problemski zadaci za provjeru ishoda učenja – primjena usvojenog znanja na konkretne slučajeve;
  2. Izrada prezentacije vlastitog istraživanja za provjeru ishoda učenja – sinteza i vrednovanje;
  3. Ocjenjivanje se provodi tijekom nastave uz odgovarajući ishod učenja i konačno na pisanom i usmenom ispitu iz kolegija. Ocjene stečene tijekom nastave uzet će se u obzir u formuliranju konačne ocjene, a kriteriji za ocjenjivanje jesu svi ishodi učenja odnosno pokazano znanje i razumijevanje materije bioetike i ljudskih prava, sposobnost primjene propisa na hipotetičke i stvarne slučajeve iz sudske prakse, sposobnost analize i sinteze te odgovarajuće vrednovanje sadržaja usvojenih tijekom nastave. Usmene prezentacije vlastitog istraživanja i sudjelovanje u raspravama.

Po prvi puta proslavlja se  World Bioethic Day, UNESCO Chair in Bioethis (Haifa) dana 19. listopada 2016. godine  na Pravnom fakutetu u Zagrebu. Posebna tema hrvatskog UNESCO Chair Unit-a je  Human Dignity and Human Rights: The rights of unborn child. Tijekom obilježavanja dana bioetike, osim predavanja pozvanih govornika   (prof.dr.sc. Ante Čović, prorektor, prof.dr.sc. Dubravka Hrabar, dekanica, prof.dr.sc. Jozo Čizmić (Pravni fakultet u Splitu), prof.dr.sc. Velinka Grozdanić (Pravni fakultet u Rijeci), prof.dr.sc. Ksenija Turković, sutkinja Europskog suda za ljudska prava,  članovi Upravnog odbora UNESCO Chair (prof.dr.sc. Iris Goldner Lang, doc.dr.sc. Sunčana Roksandić Vidlička, prof.dr.sc. Hrvoje Jurić (Filizofski fakultet u zagrebu), prof.dr.sc. Ana Borovečki (Medicinski fakultet u Zagrebu)),  održati će se i  promocija knjige Hrestomatija hrvatskog medicinskog prava  (izdavač: Pravni fakultet u Zagrebu) te će se  dodijeliti posebna nagrada za razvoj bioetike u Republici Hrvatskoj.   Tijekom obilježavanja Dana bioetike održat će se i  studentska debata  ( studenti Pravnog, medicinskog i Filozofskog fakulteta)  te rasprava penalista o pravima nerođenog djeteta. Podijelit će se i  nagrada za najbolji studentski rad iz područja bioetika: zaštita dostojanstva.   Nastavno,  pozivaju se studenti  za učestvovanje u ovom natječaju prijavom rada do najkasnije 2.10.2016. godine u opsegu od 5-10 str na hrvatskom jeziku. Molimo radove poslati na e-mail: suncana.roksandic@pravo.hr     Obilježavanje dana bioetike odvijat će se na hrvaskom jeziku. Sve UNESCO jedinice imat će istu strukturu obilježvanja, uz uvažavanje posebnosti svake UNESCO jedinice.
